Naeeni is one of the most prominent constitutional scholars that have done a lot of theories to create and consolidate the foundations of constitutionalism. He in important book -tanbi al-oma va tanziy al-mela- explained many new concepts and gave firm answers to the doubts and sophistries raised by the constitutional opposition. “hoghoghe moshtareke noeye" is a concept which is referred to in two parts of the book and without any explanation it passes through that concept. Given his careful consideration of the concepts and the need to pay attention to the history of concepts and thought, it is necessary to carefully and precisely deal with such phrases. The authors discuss this concept literally and content in this article and seek to find the basis of this phrase in the Naeeni’s thought. In this regard, the concept of equality and its various dimensions and angles as the basis of this concept are considered in the Naeeni’s thought
