Therefore, various penalties had been meted out for perpetrators of such phenomena including social unrest, robbery, acting in disobedience to the orders of the Shah and other officials, disruption to economic activities and financial affairs of the people, murder, rape, drunken brawls in public places, and the like. These punishments were performed in various manners by non-religious jurisdictions or at the behest of the Shah, local rulers, or other security officials without any established procedures. Most of the punishments were based on the expediency of the government rather than the expediency of religion or jurisprudence. Rulers determined the manner of punishment on the basis of popular preferences. This type of conventional punishment, as opposed to legal or religious punishment, was quite common during the Qajar era, as a tool for countering the widespread social unrest. This has been reflected in the chronicles of many historians and in the diaries written by many European tourists visiting Iran during the period. The present study deals with various types of punishment of criminals and the manner of practicing such punishments during the Qajar era before the Constitutional Revolution. Findings of the study show that the punishments in the period were not based on any legal standards and that decisions of the Shah and other government officials determined the manner of performing punishments, often with much violence and harshness.}, keywords = {Qajar era,security,Crimes,Punishments,Daroughah [Police official],Farrash [Guard],Executioner}, title_fa = {مجازات‌های عرفی مجرمان در عصر قاجاریه (از آغاز تا مشروطه 1209- 1324ق)}, abstract_fa = {یکی از مأموریتهای اصلی سلسلههای حکومتگر در ایران برای تداوم قدرت سیاسی خود، برقراری امنیت اجتماعی و مقابله با پدیدههایی بود که آرامش و ثبات کشور را در هم میریخت. از این رو پدیدههایی چون شورشهای اجتماعی، راهزنی و دزدی، بیاعتنایی به فرامین شاه و مأموران دولت، اختلال در وضعیت ارزاق عمومی و بازار، قتل، تجاوز به عنف، بدمستی و اموری از این قبیل؛ مجازاتهایی را درپی داشت که بدون ضابطهی مشخصی به شیوههای گوناگونی در محاکم عرفی یا به امر شاه، دستور حاکم و یا از سوی برخی مناصب سنتی امنیتی شهرها به اجرا درمیآمد. بسیاری از این مجازاتها بر مبانی فقهی و شرع استوار نبود بلکه بر اساس عرف، مصلحتهای حکومت و اختیار صاحبان قدرت قرار داشت. این شیوه مجازاتهای مبتنی بر عرف در دوره قاجاریه به دلیل ناامنیهای گسترده اجتماعی بسیار بارز بود و در گزارشهای مورخان و نیز سیاحان اروپایی دیدار کننده از ایران در این دوره بازتاب یافته است. در این مقاله انواع مجازاتهای مجرمان و شیوه اجرای آنها در دوره قاجاریه تا پیش از وقوع انقلاب مشروطه که تغییراتی در ساختار قدرت پدید میآید، تبیین شده است. یافته پژوهش نشان داده است که کیفر جرایم تابع رویه حقوقی مشخص و ضابطهمند نبوده بلکه خواست و اراده شاه و صاحبمنصبان حکومتی و تصمیم مأموران اجرایی کیفیت آن را تعیین میکرده و غالباً با شیوه خشونت و مجازاتهای سخت انجام میشده است.}, keywords_fa = {قاجاریه,امنیت,جرایم,مجازات,داروغه,فرّاش,میرغضب}, url = {https://historicalstudy.ihcs.ac.ir/article_1708.html}, eprint = {https://historicalstudy.ihcs.ac.ir/article_1708_b1dcf9d645b01bf6ccc6ed00af3d82fd.pdf} }
